Below is one of two charges of theft under $5,000 Andy Bouchard charged with on Sunday, a.m., January 30, 2006, when he barged in his father's home in Elie, with a spare key, and in a rage at being exposed by oldest sister from Calgary (who had been tipped off by youngest sister in Winnipeg) for plotting to remove hisfather Lionel Bouchard of Elie (who had a life estate agreement with Andy for the rest of his days) and with assistance of hissisters thru the guise of family banquet at the Holiday Inn, on Morey Street, in Winnipeg, stole both his father Lionel Bouchard and sister's cellular phones.Lionel Bouchard had posted a "revocation of power of attorney" on the outside of his door as Andy Bouchard had refused service the day before at his father's home.
Andy immediately breached the No Contact by sending over his wife and sisters to the house the next day had them bring over a "pre-signed agreement dated January 30, 2006, to manipulatehis father in dropping charges against him. (Click here.)
RCMP records indicate on their records that Andy Bouchard breached the order ~ no action was taken against him sending him a message that he could continue his disregard for the law as in the past! Andy Bouchard, upon discovering his power of attorney posted outside his father's doorthat Sunday morning had been revoked, along with his oldest sister from Calgary on the telephone warningboth her father and sister in Elie that her brotherAndy Bouchard had set up an "ambush" at the Holiday Inn in order toget allhis siblings to gang up against their father and evict himfrom his home of over fiftyyears, enraged STOLEbothhis father and sister's cellular telephones leaving both stranded in middle of winter without leaving them any formof communication whatsoever seeing as Lionel Bouchard hadno land line.
Fed up with Andy Bouchard's antics to pressure their father to move, which commenced immediatelyupon Lionel's discharge from the Grace Hospital on January27, 2006, three daysprior, whereby Andy had comeover to his father's house on Friday night removing his father's van on the pretense of servicing it in Portage La Prairie.
On Saturday, Andy Bouchard had gone to the St. Eustache Manor to ensure his father's room was still available whereby Lionel had already called andfaxed Manitoba Housing in Portage to cancel, this along with Andy's refusal to bring in a proper fridge for his father at the house, Lionel Bouchard and his sister of B.C. were left with no other alternative to protectLionel Bouchard but to press theft charges against Andy Bouchard at the RCMP detachment in Headingley whenleft without any means of communication, as Lionel had no landline inthe house and at the same time obtained "No Contact"orders against Andy Bouchard.
The revocation of power of attorney had been posted on the outside of Lionel Bouchard'sdoor that Sunday morning, after Andy having refused the document the day prior.
Andy Bouchard was arrested at the Holiday Inn. The stolen cellulars and otherbinder containing a new power of attorney in favour ofClaire Demery, as well as psychiatric living will,were in Andy Bouchard's possession whenarrested.
Andy Bouchard was charged with two counts of theft against his father and sister and two "No Contacts" were immediately put in place against Andy Bouchard. Having no regard for the law, Andy immediately violated that afternoon uponsending his wife and sisters Lynda Staub and ClaireDemery to the home in Elie, he himself outside in his truck in the yard in company of the RCMP, breaching the No Contact orders by dropping off hiswife (indirect contact) who screamed obscenities at hissister. Lynda Staub already having put her sister'sluggage outside in the snow bank having locked the front door of her father's house!
On Sunday, Andy Bouchard, after being charged withtwo counts of theft, immediately faxed title to the property concealing the fact that his father having a "Right of Occupancy"agreement which Andy Bouchard had maliciously and deliberately omittedregisteringon title in 2002 despite its existence. Using this legal technicality, Andy violated his father's rights as a "tenant" under the Life Estate Act, to havehis sister from B.C. ~ his temporary caregiver at the time, removedfrom the property.
Andy Bouchard then installedLynda Staub, who missed work the following day, as caregiver that night, forcing his sister from B.C. to take a motel room in Winnipeg for the night. Arrangements werethen made by Andy Bouchard to have Susie Waldner look after their father the following days Susan Waldner called Andy Bouchard. After waiting the day, cancelling her commitment to work,Andy did not show to pick her up fearing she would support Lionel - her ex-fiancée. Lynda Staub missed work on Monday January30,2006, to replace her sister's care giving forher father!
The next day, Lynda Staub began an agressive telephone campaign on behalf of Andy to lure sisterto the property tosign an agreement allowing their father to remainon the property in exchange fordropping the both dropping theftcharges against Andy Bouchard. Lynda Staub took it upon herself to call the RCMP to warnthem in advance the charges would be dropped by 4:00 p.m when noagreement had yet been arrivedto meet at 5L00 p.m.! Immediately after signing this agreementaround 5:00 p.m., in the presence ofClaire Demery and her father, Lynda Staub immediately ordered her sister to leave their father's home so as not to provide home care that night as arranged at the hospital!
Immediately recognizing that her siblingshad NOTbeendealing in good faith, and had no intentions of honouring this agreement, sister boarded a plane at 7:00 p.m. - two hours later for B.C. to regroup fearingthat her father would be moved immediately from hishome against his wishes.
The next morning at 8:30 a.m., Andy Bouchard drovehis father in to remove the "theft charge" and "No Contact" order against him, and in so doing breached the No Contact Order against him.
Second theft charges stayed! Appears no penalty for stealing from "family members"as Crown Tim Owen deemed Andy's actions of theft simply a "family dispute"??? Yet Crown McDuff upheld the other "family dispute alleged charges of assaults, attempted kidnap, stayed after holding sister in remand for nearly four months and forced to undergo an assessment based on fabricated documents by Andy Bouchard to the Court!
