Legal Profession Act
Purpose:
3 (1) The purpose of the society is to uphold and protect
the public interest in the delivery of legal services
with competence, integrity and independence.
Duties:
3 (2) In pursuing its purpose, the society must
(a) establish standards for the education,
professional responsibility and competence of
persons practicing or seeking the right to
practise law in Manitoba; and
(b) regulate the practice of law in Manitoba.
DEFINITION OF PROSECUTOR
Senior abuse is most often a hidden crime exacting a horrific toll on its unsuspecting victims, resulting in their:
The prosecutor is the gatekeeper to the criminal justice system.
It is the responsibility of the prosecutor to advocate for justice and ensure that the voices of older victims are heard.
In elder abuse cases, the prosecutor should make every effort to:
• Enhance victim safety by addressing any special needs of the elder victim
• Restore what has been taken from the victim
• Gather evidence and preserve testimony using methods that will improve the likelihood of admissibility at trial should the elder victim be unable or unwilling to testify
• Hold the offender accountable and protect the community
• Rehabilitate the offender in appropriate circumstances.
Currently prosecutors do not back their responsibility of the positions granted to them.
