Andy Bouchard's affidavit, to frustrate the possession order that was about to be issued to Lionel Bouchard in August 2011, Andy Bouchard's lawyer claims there is an "amendment to the original agreement" conveniently not in court on the day of the hearing, a stall tactic designed to adjourn the matter two weeks.
The original agreement at the time of the sale of the second half of the property, states that Lionel Bouchard will remain in hishome for the rest of his days
It is alleged Andy Bouchard never had any intentions of honouring his legal commitment as documents:
-never registered as caveat on title as is par for the course, and a legal requirement - nor the registration of the mortgage his father held on Andy Bouchard's behalf, interest free!
In court in August 2008, as the first time his father ever heard about his "amendment".
Lionel Bouchard claims this is a forgery. (Click here.)
Andy Bouchard wrote a cheque for $2,000, on his father's birthday January 22, 2008, stating in the memo "paid in full". Yet in court, Andy Bouchard admits he owes his father a balance of $7,000 annual payments on the mortgage.
The $2,000 cheque was turned over to Winston Smith for evidence and never cashed.
